Pour les autres postes l\u2019examen doit \u00eatre fait dans les deux mois de l\u2019embauchage. \u00bb<\/p>\n<p>L\u2019examen m\u00e9dical d\u2019embauchage a pour objet de d\u00e9terminer si le candidat est apte ou inapte \u00e0 l\u2019occupation envisag\u00e9e.<\/p>\n<p>L\u2019examen m\u00e9dical d\u2019embauchage doit \u00eatre effectu\u00e9, outre sur les salari\u00e9s vis\u00e9s \u00e0 l\u2019article L. 321-1, paragraphe (4), sur les \u00e9l\u00e8ves et \u00e9tudiants b\u00e9n\u00e9ficiant d\u2019un contrat r\u00e9gi par le livre Ier, titre V et sur les \u00e9l\u00e8ves en stage de formation, du moment qu\u2019ils effectuent un travail sur un poste \u00e0 risques vis\u00e9 \u00e0 l\u2019article L. 326-4.<\/p>\n<p>Au cas o\u00f9 l\u2019examen m\u00e9dical d\u2019embauchage a lieu apr\u00e8s l\u2019embauchage, le contrat de travail est conclu sous condition r\u00e9solutoire.<\/p>\n<p>La condition r\u00e9solutoire est r\u00e9alis\u00e9e, et le contrat de travail se trouve en cons\u00e9quence r\u00e9sili\u00e9 de plein droit, du fait de la d\u00e9claration d\u2019inaptitude du salari\u00e9 \u00e0 l\u2019occupation envisag\u00e9e lors de l\u2019examen m\u00e9dical d\u2019embauchage.<\/p>\n<h5>Art. L. 326-2.<\/h5>\n<p>Si un salari\u00e9, ayant pass\u00e9 l\u2019examen d\u2019embauchage pour un premier poste, est affect\u00e9 \u00e0 un autre poste pr\u00e9sentant des conditions de travail sensiblement diff\u00e9rentes avec des risques virtuels pour la sant\u00e9 des salari\u00e9s, l\u2019employeur est tenu d\u2019en avertir le m\u00e9decin du travail qui d\u00e9cide de la n\u00e9cessit\u00e9 \u00e9ventuelle d\u2019un nouvel examen.<\/p>\n<p>Si un salari\u00e9 change d\u2019employeur, le m\u00e9decin du travail comp\u00e9tent en vertu du nouveau poste peut, sur le vu de la derni\u00e8re fiche d\u2019examen m\u00e9dical \u00e9tablie en rapport avec le poste pr\u00e9c\u00e9dent conform\u00e9ment \u00e0 l\u2019article L. 326-8, conclure \u00e0 l\u2019aptitude du salari\u00e9 pour le nouveau poste, si celui-ci ne pr\u00e9sente pas de conditions de travail sensiblement diff\u00e9rentes avec le poste pr\u00e9c\u00e9dent. Si le poste nouveau rel\u00e8ve d\u2019un autre service de sant\u00e9 au travail que l\u2019ancien, ce dernier est tenu de remettre la derni\u00e8re fiche d\u2019examen m\u00e9dical au service de sant\u00e9 au travail d\u00e9sormais comp\u00e9tent, \u00e0 la demande de celui-ci.<\/p>\n<h5>Art. L\u2019inventaire et les mises \u00e0 jour sont communiqu\u00e9es au m\u00e9decin chef de la division de la sant\u00e9 au travail aupr\u00e8s de la direction de la sant\u00e9, qui arr\u00eate pour chaque employeur la liste des postes \u00e0 risques.
